314 NLRB No. 104.Case No. 29-CA-16056 and -16167. July 28, 1994 D. Barry Morris, Administrative Law Judge..
Before Stephens, Devaney and Cohen.
Thomas M. Maher, for General Counsel. Barnett Friedman, Brooklyn, New York, for Respondent.
Refusal to Reinstate--Unconditional Application--Conversion to ULP Strike.--An employer unlawfully refused to reinstate strikers who had initially walked off their jobs for economic reasons and then were fired, despite the fact that they made an unconditional application to return to work. Upon their termination, the economic strike was converted to an unfair labor practice strike and the employer was obligated to reinstate them upon their absolute request for reinstatement. Section 8(a)(3).

Threats--Discharges--Concerted Economic Reasons.--Once employees walked off their jobs to protest an employer’s economic conditions, the employer unlawfully threatened them with discharge if they did not return to work. Such a threat of discharge violated the Act because it interfered with the employees’ right to engage in concerted and protected activity. Section 8(a)(1).
