315 NLRB No 62.Case No. 22-CA-18609. October 31, 1994 Steven Davis, Administrative Law Judge..
Before Gould, Browning and Cohen.
Chevella Brown-Maynor, for General Counsel. Paul A. Montalbano (Schneider, Gouldberger, Cohen, Finn, Solomon, Leder & Montalbano, Esqs.), Cranford, New Jersey, for Respondent.
Threats--Shutdown of Plant--Failure to Repudiate.--By threatening to close its plant or subcontract unit work if its employees selected a union to represent them, an employer interfered with the employees’ right to freely choose a bargaining representative. Although the employer claimed that it repudiated that statement, it failed to do so because the disavowal of the statement came more than a month later and failed to assure employees that the employer would not interfere with their Section 7 rights in the future. Section 8(a)(1).
Back reference: ¶3770.302.
Discrimination--Fact Finding--Antiunion Motives.--On the facts, by assigning an employee to a less-favorable long distance truck route, an employer discriminated against him because of his support for a union. Section 8(a)(3).
