Before Devaney, Browning and Cohen.
Emily Do So, for General Counsel. Michael Salgo, for Respondent.
Discrimination--Proof of Intent--Filing of Grievance.--By discharging and, thereafter, refusing to reinstate an employee because he intended to file a grievance with his union, an employer discriminated against him. The employer admitted that this was the reason for the employee’s termination, and the employer harbored prior antiunion animus toward him because of his previous complaint to the union regarding the fact that the employer refused to permit him to register as a union member. Section 8(a)(3).
