BAKERSFIELD MEMORIAL HOSPITAL and INTERNATIONAL BROTHERHOOD OF TEAMSTERS, LOCAL NO. 87, AFL-CIO.
315 NLRB No. 53.Case Nos. 31-CA-19878 and 31-RC-6923. November 16, 1994 William J. Pannier III, Administrative Law Judge..
Before Devaney, Browning and Cohen.
Gary Freelen Ellison, for General Counsel. Gary F. Overstreet (Musick, Peeler & Garrett), Los Angeles, California, for Respondent Employer. James Rutkowski (argued), (Van Bourg, Weinberg, Roger & Rosenfeld), James G. Varga, Los Angeles, California, for Union Petitioner.
Election Objections--Employer Interference--Promises Before Election.--Prior to a rerun union representation election, an employer committed several unfair labor practices in an attempt to dissuade its employees from their union support and interfere with a free and fair election. These coercive unlawful acts included promising improved benefits, creating the impression that union activities were under surveillance and soliciting employee desires for benefit improvements. Consequently, a third representation election was ordered by the NLRB. Section 8(a)(1).
