E.G. & G. ROCKY FLATS, INC. and UNITED STEELWORKERS OF AMERICA, LOCAL UNION 8031, AFL-CIO-CLC.
314 NLRB No. 81.Case No. 27-CA-12267. July 22, 1994 William J. Pannier III, Administrative Law Judge..
Before Gould, Stephens and Devaney.
William J. Daly and Diana M. Munkel, for General Counsel. Carl Eiberger (Eiberger, Stacy, Smith & Martin), Denver, Colorado and Mary Ellen Amaral, Golden, Colorado, for Respondent. Dennis Valentine (Brauer, Buescher, Valentine, Goldhammer & Kelman), Denver, Colorado, for Charging Party.
Unilateral Changes by Employer--Work Conditions--New Training Procedure.--By unilaterally suspending the familiarization portion of a training program that previously was prescribed in its operations manual and, thereafter, conducting training familiarization in a different manner, an employer violated its bargaining duty. The employer failed to give a union notice or an opportunity to bargain over the changes and its claimed defense that the procedure was too expensive and inconvenient was untenable. Section 8(a)(5).
