Vital Briefing article breaks down measure’s requirements for developers of “large frontier” AI models to assess catastrophic risks, report critical safety incidents, undergo independent third-party audits, and establish whistleblower protections.

Both houses of Illinois’ legislature have passed the proposed “Artificial Intelligence Safety Measures Act” (SB 315), which could impose the most stringent requirements in the nation for developers of the most cutting-edge AI systems, known as “frontier models.” Governor J.B. Pritzker praised the bill on social media platform X and said he looked forward to signing it.

A key feature of the legislation is its requirement that frontier AI developers publish and comply with a framework detailing how they will assess and mitigate catastrophic risks. The framework also must establish cybersecurity practices. The legislation would require frontier developers to report critical safety incidents to the Illinois Emergency Management Agency and the Office of the Attorney General within 72 hours or within 24 hours if the incident poses an imminent risk of death or serious physical injury. The Illinois law, if enacted, would go farther than other states’ AI safety laws in California and New York by mandating independent annual audits to assess compliance. The law would be enforced by the Illinois Attorney General and would not provide for a private cause of action.

More information about the legislation can be found in the article titled “Illinois on the verge of enacting nation’s toughest ‘frontier AI’ safety law,” available here.
