The Consumer Product Safety Commission (CPSC) has extended the comment period for a proposed rule that would establish a safety standard for toys containing button cell and coin cell batteries. The notice of proposed rulemaking (NPR), which was published in August 2024, had invited the public to submit written comments during a 60-day period ending on October 15, 2024. Due to a delay in releasing incident data supporting the NPR, CPSC is extending the comment period by 30 days. Comments are now due by November 14, 2024 (CPSC Proposed rule; extension of comment period, 89 Fed. Reg. 79488 (Sept. 30, 2024)).
The NPR would amend the requirements in 16 C.F.R. part 1250 specific to battery compartments for toys containing button cell or coin cell batteries. The amendments would align the requirements more closely with the Commission’s new rule for consumer products containing button cell or coin batteries, codified at part 1263, and provide the highest level of safety that is feasible.
The incident data was to be made available when the NPR was published on August 13, 2024, but was delayed until September 10, 2024. CPSC thus extended the comment period to give the public sufficient time to review and comment on the data.
