Antitrust Law Daily Wrap Up, CONSUMER PROTECTION NEWS: Arkansas used car dealer charged by FTC for failure to display Buyer's Guides, (Mar 17, 2014)
The FTC has filed a complaint in the federal district court in Jonesboro, Arkansas against an Arkansas auto dealer and its two principals for failing to display a Buyers Guide on used vehicles offered for sale. The FTC's Used Car Rule requires used car dealers to disclose whether the car comes with a dealer’s warranty or is being sold “as is.” Each violation could result in a civil penalty of up to $16,000. (FTC v Abernathy Motor Co., FTC File No. 132 3173, Civil Action No. 3:14-cv-00063 BRW/BD)
This follows warnings issued by the FTC in January 2013 to eleven used car dealerships in Jonesboro, Arkansas concerning the lack of Buyer's Guides on used cars offered for sale. Subsequent to those warnings, all but Abernathy Motor Co. came into compliance, the FTC reported. The auto dealer has four used car sales locations and is affiliated with a new car dealership, Ab’s Best Buys AMC Inc.
