Cybersecurity Policy Report, Nebraska Lawmakers Eye Data-Collection Tax for Social Media Companies, (Feb 13, 2026)
The Nebraska state Legislature’s Committee on Revenue meets Feb. 18 to discuss a bill that would establish an excise tax on social media platforms that collect consumer data from Nebraska residents.
The Social Media Collection of Consumer Data Tax Act (LB 1025) would establish a tiered excise tax on social media companies collecting data from Nebraska residents and use the revenue to fund juvenile mental health services. Internet search providers, e-mail services, streaming platforms, and professional networking sites would be excluded from the definition of a social media platform under the bill.
Beginning Jan. 1, 2027, the tax would be structured in tiers based on the number of Nebraska consumers whose data is collected as follows: no tax for fewer than 50,000 consumers, $0.10 per consumer per month for 50,001 to 250,000 consumers, $40,000 plus $0.25 per consumer per month for 250,001 to 500,000 consumers, and $165,000 plus $0.50 per consumer per month for over 500,000 consumers.
All revenue generated from the tax would be provided to a new Juvenile Mental Health Support Fund and used to support programming and facilities for juvenile mental health services.
The bill (L.B. 1025, Reg Sess.) is sponsored by Carolyn Bosn (R.).
