    The FCC’s Enforcement Bureau issued orders today directing China Unicom (Hong Kong) Operations Ltd. (CUHK), China Mobile Hong Kong Co. Ltd. (CMHK), and China Telecom Global Ltd. (CTG) to “cure deficiencies” in their Robocall Mitigation Database (RMD) certifications or explain why their inclusion in the RMD is not contrary to the public interest.

    The removal of the companies’ certifications from the RMD would require all intermediate providers and voice service providers to cease accepting all calls directly from the companies that use North American Numbering Plan resources that pertain to the U.S., the bureau noted in its orders regarding CUHK (EB-TCD-25-00039520), CMHK (EB-TCD-25-00039513), and CTG (EB-TCD-25-00039418).

    In the orders, the bureau noted that all three companies had not submitted required robocall mitigation plans by a Feb. 26, 2024, deadline the FCC established in a May 2023 order that required additional information with RMD certifications. The FCC recently removed the RMD certifications of nearly 1,400 service providers for failing to maintain accurate certifications (CPR, Aug. 25).

    The bureau said in the orders regarding CUHK, CMHK, and CTG that because of their ties to the Chinese government each posed national security risks and there was “no question that protecting against national security threats from foreign adversaries is in the public interest.”

    The companies have 14 days to respond, the bureau said. “Failure to respond and correct the deficiency or provide a sufficient explanation for why the Bureau should not remove the Company’s certification from the RMD will result in removal of the Company’s certification.”

    If the companies are removed from the RMD, they would not be permitted to refile for certification without the consent of the Enforcement Bureau and Wireless Competition Bureau.
