“Are you a white male who has experienced discrimination at work based on your race or sex? You may have a claim to recover money under federal civil rights laws. Contact the EEOC as soon as possible.”

Yesterday, on the social media platform LinkedIn, EEOC Chair Andrea Lucas issued an announcement, along with a video, sharing a magazine article recounting one white man’s experiences that he believes demonstrates he has been the subject of discrimination. Lucas specifically targeted white male viewers and readers, asking: “Are you a white male who has experienced discrimination at work based on your race or sex?” She told this audience, “You may have a claim to recover money under federal civil rights laws. Contact the EEOC as soon as possible.”

“Americans are lazy.” Meanwhile, this week the EEOC announced a lawsuit against United Pride Dairy LLC in Phillips, Wisconsin, alleging violations of Title VII and claiming the dairy misled three Mexican workers by promising professional or management roles for their TN visas but instead assigned them laborer positions with harsher tasks and shifts. When one worker objected, a manager justified the disparity using stereotypes about American workers (stating that “Americans are lazy”).

The suit also claims a female Mexican employee endured sexual harassment from her supervisor, who shared pornographic images and made offensive remarks. EEOC Chair Lucas emphasized that discrimination based on national origin and sex, as well as misuse of visa processes, is unlawful. The agency seeks monetary damages for affected employees and injunctive relief to prevent future violations, reaffirming its commitment to protecting all workers from discriminatory practices and harassment in the workplace.

Subpoena compliance ordered. Also this week, the EEOC shared that a federal court in California ordered the supermarket chain Vallarta Food Enterprises, Inc., and related companies, to fully comply with subpoenas issued by the agency in September 2024 relating to Commissioner-initiated charges. The charges allege that the employer failed or refused to recruit, hire, or promote individuals based on their race (white, Black, and/or Asian) and national origin (non-Hispanic).

“The court recognized EEOC’s broad authority to obtain subpoena compliance from employers when the agency seeks information to investigate discrimination and enforce Title VII’s protections for workers,” said Lucas. “The records Vallarta Supermarkets has been ordered to provide are important in investigating whether the company unlawfully excluded non-Hispanic workers from employment.”

    The case is No. 2:25-mc-00058.
