ADVERTISING NEWS: The U.S. Court of Appeals in Philadelphia has vacated a district court’s denial of a preliminary injunction in an action for unfair competition and trademark infringement. Investment company Arrowpoint Capital Corp. sought to enjoin Arrowpoint Asset Management LLC from using a logo or word mark employing the name “Arrowpoint” in connection with any investment products and services. In vacating and remanding the lower court order, the appellate court found that the district court ruling was based on an overly narrow interpretation of the kind of confusion that was actionable under the Lanham Act (Arrowpoint Capital Corp. v. Arrowpoint Asset Management, LLC, July 16, 2015).
