A periodic roundup of other items of interest to the Antitrust and Trade Regulation community:

ANTITRUST—E.D. Pa. In multidistrict litigation concerning an alleged conspiracy to fix the price of eggs, direct purchasers have been reimbursed more than $1.3 million for expenses and each individual class representative has been awarded $25,000 as an incentive award. The court concluded that the proposed incentive awards were reasonable because the plaintiffs secured more than $50 million in settlements and the class representatives placed themselves at risk of retaliation by defendants, given their continued purchase of eggs and egg products following the litigation (In re Processed Egg Products Antitrust Litigation, July 5, 2016, Pratter, G.).

ANTITRUST—D.N.J. Pharmaceutical companies SmithKline Beecham Corp. and Teva Pharmaceutical Industries Ltd. have been denied a request to stay proceedings, in a pay-for-delay action concerning the prescription drug Lamictal, pending the Supreme Court’s final ruling on a petition for certiorari in the related case SmithKline Beecham Corp. v. King Drug Co. of Florence (Dkt. 15-1055). Alleged indirect purchasers claimed that the two pharmaceutical companies entered into an agreement to delay generic competition for the medication Lamictal, a prescription drug that is used to treat epilepsy and bipolar disorder (In re Lamictal Indirect Purchaser and Antitrust Consumer Litigation, July 6, 2016, Walls, W.).
