While identifying risks presented by disinformation and security breaches, report announces that the conversation in the legal profession has shifted from whether to use AI to how to use it.

The American Bar Association’s Task Force on Law and Artificial Intelligence released its “Year 2 Report on the Impact of AI on the Practice of Law” on December 15. The report contains insights, practical guidance, and recommendations that, as ABA Immediate Past President William R. Bay states, “uphold our profession’s core values of competence, integrity, and public trust.” While bluntly describing the downsides—such as the use of AI to spread disinformation, including deepfakes, and harms to IP rights—the task force focuses on ways for law firms, lawyers, and the judiciary to make the best possible uses of AI technologies.

“Over the last year,” states the report, “we have moved from a fear of the unknown unknowns to a realization that the known unknowns present challenges for firms to face as they employ tools that, when used properly, enhance productivity, reduce the likelihood of errors, and enable attorneys to deliver higher-quality service to clients.”

The report is divided into sections that discuss the impacts of AI on the practice of law, the courts, alternative dispute resolution, intellectual property, cybersecurity, data privacy, insurance, and other topics, including a look at the long-term future of the technology in the legal realm.

A new Vital Briefing article looks at the report’s highlights, particularly its recommendations for AI use in law practice. The article, titled “ABA task force’s report on AI and practice of law examines risks, rewards,” is available here.
