The US Supreme Court has agreed to hear the US Administration's appeal in relation to the legality of US President Donald Trump's reciprocal tariff agenda.

The appeal follows a second ruling against the legality of the tariffs on US trade partners, and of the "fentanyl tariffs" on China, Canada, and Mexico.

In its August 29, 2025, judgment, the US Court of Appeals for the Federal Circuit concurred with an earlier judgment from the Court of International Trade that the President lacks the authority to bypass Congress in imposing the aforementioned tariffs.

However, the Court, in its 7-4 decision, said the tariffs may remain until mid-October.

Agreeing to hear the appeal, the US Supreme Court set out deadlines for the filing of briefs during September and October 2025. Hearings will begin during the first week of November, starting from November 3, 2025.
