The U.S. District Court for the Eastern District of Virginia granted a motion for a preliminary injunction last week in a lawsuit filed by state attorneys general to stop the Federal Motor Carrier Safety Administration (FMCSA) from obtaining the sensitive personal information of holders of commercial driver’s licenses (CDLs).
The lawsuit, filed last month by a group of 22 attorneys general and the state of Pennsylvania, challenged the Trump administration’s authority to obtain CDL data (CPR, Aug. 14). District Judge Anthony Trenga had already issued a temporary restraining order preventing the departments of Transportation and Homeland Security from gaining access to the Commercial Driver’s License Information System (CDLIS) from the American Association of Motor Vehicle Administrators (AAMVA) (CPR, Aug. 20).
California Attorney General Rob Bonta (D.) said Friday in a press release that the preliminary injunction barred FMCSA from obtaining CDL data as the litigation continues. “This ruling ensures that Americans’ privacy rights remain protected as our case continues,” he said. “California will continue to stand up for the rule of law and work to protect the privacy of Californians and commercial drivers across the country.”
