Cybersecurity Policy Report, South Dakota House Committee Advances Data-Portability Bill, (Feb 24, 2026)
The South Dakota state House State Affairs Committee voted 10-3 this week to pass a bill that would require large social media companies to provide users with access to their personal data and enable secure, user-controlled data-sharing and interoperability between platforms.
SB 111 would require social media companies with more than 100 million active monthly users whose primary focus is not charity or religion to give users access to their collected personal data upon request. Personal data would have to be provided in a “portable, readily usable format that allows for seamless transmission to another social media service,” according to the bill.
To ensure interoperability, the bill would stipulate that social media companies should use open protocols, maintain non-discriminatory data-sharing practices, and provide equivalent access to internal interfaces for other companies.
The bill has an effective date of July 1, 2027.
The bill (S.B. 111, Reg Sess.) is sponsored by Sen. Michael Rohl (R.).
