A bill introduced this week in the Alaska state House proposes to create consumer data privacy rights and regulate data brokers operating in the state.

The Consumer Personal Information Privacy Act (HB 367) would allow consumers to opt out of the sale, sharing, or disclosure of their information. It would also require businesses that collect personal information from consumers to provide clear notice before collection, specifying the categories of data collected, purposes of use, and consumers’ rights. It would require covered businesses to maintain updated privacy policies, limit data collection and retention to what is necessary for requested services or security, and provide consumers with mechanisms to access, delete, or restrict the use of their personal information.

The bill also would impose new requirements on data brokers. Among other things, it would require data brokers to register with the state, pay registration and revenue-based fees, and disclose certain information to the public.

The bill would direct the state attorney general to adopt regulations for implementation, including defining technical terms, establishing exceptions, and ensuring accessibility of notices and consumer rights information.

The bill (HB 367, Reg Sess.) is sponsored by Rep. Andi Story (D.). It has been referred to the House Judiciary Committee.
