GM will contact owners of the affected vehicles, and dealers will replace the front passenger air bag inflator with an alternate one, free of charge.

General Motors, LLC (GM) is recalling approximately 5,953,594 vehicles because they are equipped with non-desiccated passenger frontal air bag inflators containing phase-stabilized ammonium nitrate (PSAN) propellant. These inflators may explode due to propellant degradation occurring after long-term exposure to high absolute humidity, high temperatures, and high temperature cycling. Such an inflator explosion may result in sharp metal fragments striking the driver or other occupants, resulting in serious injury or death (NHTSA Recall Notices, Nos. 21V050, 21V051, 21V052, 21V053, and 21V054, Report receipt date: February 5, 2021).

The five recalls, of model year (MY) 2007–2014 GMT900 vehicles in designated Zones A, B, and C, follow the National Highway Traffic Safety Administration’s (NHTSA) denial of GM’s consolidated petition for a decision of inconsequential defect in November 2020 relating to TK Holdings Inc. (Takata)-manufactured passenger-side frontal air bag inflators which were supplied to GM for use in MY 2007–2014 GMT900 (full-size pickup and SUV platform used in 2007 to 2014 model year vehicles) vehicles [see Products Liability Law Daily’s December 3, 2020 analysis]. GM petitioned NHTSA for a decision that, because of differences in inflator design and vehicle integration, the equipment defect determined to exist by Takata was inconsequential as it related to motor vehicle safety in GM’s GMT900 vehicles, and, therefore, that GM should be relieved of its notification and remedy obligations under the National Traffic and Motor Vehicle Safety Act of 1966 (Safety Act) and its applicable regulations. NHTSA rejected GM’s arguments, concluding that GM failed to meet its burden of establishing that the defect was inconsequential to motor vehicle safety. GM’s focus on whether the allegedly defective part was likely to fail had very little bearing on whether the alleged defect was a safety concern. As a consequence of the denial of the petition, GM became obligated to provide notification of, and a remedy for, the defect pursuant to the Safety Act.

GMT900 is a GM-specific vehicle platform that forms the structural foundation for a variety of GM light- and heavy-duty pickup trucks and sport utility vehicles, including: Chevrolet Silverado 1500, GMC Sierra 1500, Chevrolet Silverado 2500/3500, GMC Sierra 2500/3500, Chevrolet Tahoe, Chevrolet Suburban, Chevrolet Avalanche, GMC Yukon, GMC Yukon XL, Cadillac Escalade, Cadillac Escalade ESV, and Cadillac Escalade EXT.
