“[T]he U.S. legal cannabis market generates roughly $30 billion to $38 billion in annual regulated retail sales and supports more than 425,000 full-time-equivalent jobs.”

In this month’s Labor Pulse, Jim Castagnera thinks about the application of federal preemption in the field of state cannabis regulation, which has increasingly begun to embrace requirements of labor neutrality that have, in turn, recently attracted the attention of the NLRB.

“Looking for guidance to the Fair Labor Standards Act, the NLRB’s touchstone in ag cases,” Jim observes, “a unanimous three-Member Board found that the post-harvest crew wasn’t working in agriculture, a ‘nuanced’ determination ‘not susceptible to rigid or precise definition’ (BeLeaf Medical, LLC, 374 N.L.R.B. No. 100 (Apr. 23, 2026).”

To learn more about these developments, enjoy Jim’s latest Labor Pulse article, “Organized Labor in the Shadowland of Cannabis Regulation: A Case Study.”
