“To borrow from Mark Twain, reports of the Board’s death may be ‘greatly exaggerated.’”

In this month’s Labor Pulse, Jim Castagnera ponders the near future of the NLRB, which turns 90 years old in July but currently lacks a quorum and is relatedly beset by a controversy over the lawfulness of President Trump’s removal of Member Gwynne Wilcox, its sole remaining Democrat, in January.

“Not wanting to turn this into a law review article,” Jim observes, “suffice my saying that a Marbury v. Madison-style challenge to Trumpian recalcitrance doesn’t look like a winner to me.”

To learn more about these developments, enjoy Jim’s latest Labor Pulse article, “Are We Witnessing the Demise of the National Labor Relations Board?”
