The Irish Revenue has announced the release of new stamp duty guidance on consanguinity relief.

Schedule 1 to the Stamp Duties Consolidation Act (SDCA) 1999 specifies the rates of Stamp Duty that apply in relation to each instrument listed in the schedule.

The rate of Stamp Duty charged on the acquisition of non-residential property is 7.5 percent of the consideration. This rate has been in place since 12 October 2017.

Non-residential property for Stamp Duty purposes includes land business premises, and business assets such as goodwill, book debts, or benefit of contracts.

Schedule 1 makes provision for a reduced rate of one percent to apply on conveyances and transfers of land between certain related persons, which is generally referred to as "consanguinity relief".

The new guidance is intended to provide in-depth guidance for taxpayers on the relief, in particular on the conditions that must be satisfied for initial and continued access to the relief.

The guidance also covers when the relief will be withdrawn and the interaction between consanguinity relief and young trained farmer relief.
