Cybersecurity Policy Report, International Data Transfer Resource Offered by Brazil’s DPA, (Sep 25, 2024)

The National Authority for Protection of Data (ANPD), Brazil’s data protection authority, announced yesterday that it had launched a specific webpage on international data transfers on its official website.

According to the ANPD’s announcement, the launch of the webpage aims to ensure greater transparency and facilitate the understanding of companies and citizens about the mechanisms that govern the movement of personal data outside of Brazil. The new webpage is an accessible platform where data controllers and operators can find guidance on submitting electronic requests and processing requests for analysis of international data transfer mechanisms. Among the specific mechanisms covered on the webpage are standard contractual clauses (SCCs), global corporate standards, and adequacy decisions.

In addition, the page includes a frequently asked questions section that offers “clear and objective answers” about Brazilian data protection law and how it regulates international data transfers. “This ANPD initiative strengthens the data protection environment in Brazil, ensuring that the flow of sensitive information out of the country occurs in compliance with the strictest international privacy and security standards,” the announcement said. “Standardizing these processes is essential, given the growing volume of data circulating globally and the increase in international business operations, which depend on secure information exchange practices.”
