Health Law Daily Wrap Up, CONTROLLED SUBSTANCES—FINAL RULES: DEA targets emerging kratom-derived opioids with Schedule I action, (Aug 28, 2026)
By WK Editorial Staff
DEA temporarily placed three kratom-related synthetic opioids in Schedule I, citing serious overdose, addiction, and public safety concerns.
The DEA issued a temporary order placing mitragynine pseudoindoxyl, MGM-15, and MGM-16, three synthetic substances related to 7-hydroxymitragynine, in Schedule I of the Controlled Substances Act after finding that they pose an imminent hazard to public safety. The agency cited evidence that mitragynine pseudoindoxyl and MGM-15 are being marketed and sold nationwide in consumer products, often promoted as mood enhancers or alternatives to prescription opioids despite their potent opioid effects and lack of FDA-approved medical uses. DEA stated that the substances have high abuse potential, may cause dependence and respiratory depression, and have been identified in overdose and toxicology cases, including fatal events. The temporary scheduling order, effective August 26, 2026, imposes Schedule I regulatory controls and will remain in effect for up to two years while the agency considers permanent scheduling (Final Rule, 91 Fed. Reg. 54948 (Aug. 26, 2026)).
Dates. This temporary order is effective August 26, 2026, until August 26, 2028. If this order is extended or made permanent, DEA will publish a document in the Federal Register.
