A bill to modify the Utah Commercial Email Act has been sent Utah Gov. Spencer Cox (R.) for his signature.

SB 123, among other things, revises the definition of “unsolicited commercial email” to mean a commercial e-mail sent by an advertiser to a recipient that “results in delivery of an email to a server in Utah.”

The bill also removes the word “knowingly” as it relates to an advertiser that initiates a commercial e-mail. According to the bill, an advertiser may not initiate or advertise in a commercial e-mail sent from this state or sent to a Utah e-mail address if (1) the commercial e-mail contains or is accompanied by a third party's domain name without the permission of the third party; (2) the e-mail contains or is accompanied by false, misrepresented, or forged header information; or (3) the commercial e-mail has a subject line that is likely to mislead a recipient “about a material fact regarding the identity of the advertiser, the contents, or the subject matter of the commercial email.”

The bill is sponsored by Sen. Kirk Cullimore (R.).
