Antitrust Law Daily Wrap Up, ANTITRUST NEWS: Japan Fair Trade Commission issues cease and desist orders, 255.42 million yen in surcharge orders to starch adhesive manufacturers, (Jul 15, 2013)
By Tobias J. Gillett, J.D., LL.M.
The Japan Fair Trade Commission (JFTC) has issued cease and desist orders and surcharge payment orders against certain companies involved in the manufacture and sale of starch adhesive for corrugated board, the agency announced last week. The JFTC concluded that the companies restrained competition in the market for the sale of specific starch adhesive used for manufacturing corrugated board by entering into an agreement, by at least as early as November 2010, to raise the selling price for the adhesive. The surcharge orders total 255.42 million yen.
The JFTC notified the companies of contents of the proposed orders and permitted them to present opinions and evidence prior to issuing the orders. The recipients of the orders may request the JFTC to initiate hearing procedures regarding the orders within sixty days of the date on which the transcript of the orders was served.
