PRIVACY NEWS. The FTC has sent warning letters to 28 companies purportedly claiming certified participation in the Asian Pacific Economic Cooperative’s (APEC’s) Cross-Border Privacy Rules (CBPR) system, without appearing to have met the requirements to make that claim. The APEC privacy system is a self-regulatory initiative to increase the protection of consumer data moving among APEC member economies through a voluntary but enforceable code of conduct implemented by participating businesses, the FTC stated. To be certified as compliant with the APEC CBPR program requirements, companies must meet nine data privacy principles, including preventing harm, notice, collection limitation, use choice, integrity, security safeguards, access, correction, and accountability. The letter requests that the 28 companies immediately remove all representations that could be construed as claiming APEC CBPR participation, and to contact the agency within 45 days to disclose their compliance.
CONSUMER PROTECTION NEWS. A group of lead generators who allegedly participated in a massive technical support scam that was shut down by the FTC and the State of Florida have settled allegations that they participated in a scheme that conned tens of thousands of consumers out of more than $120 million by deceptively marketing computer software and tech support services. Under the terms of the stipulated final order, the lead generator defendants will be required to perform due diligence on business prior to generating and selling leads to those entities and pay $258,000. The defendants are also prohibited from deceiving consumers in the process of selling goods and services (FTC v. Inbound Call Experts, LLC, File No. 132 3135, Dkt. 9:14-cv-81395-KAM).
