Louisiana Gov. Jeff Landry (R.) has signed S.B. 386 (Act 502), Reg Sess. (La. 2026), the Louisiana Data Privacy Act (LDPA). The signing makes Louisiana the third state to adopt a comprehensive privacy law in 2026, after Oklahoma and Alabama.

In this Vital Briefing, Wolters Kluwer Senior Legal Analyst Tony Foley analyzes the law’s requirements, which track closely with privacy laws enacted in other states with a few notable exceptions. The Louisiana law contains elements commonly associated with the California Consumer Privacy Act, including its primary applicability thresholds but also incorporates elements of the laws enacted in a variety of states that built on the model provided by the Washington Privacy Act. The briefing also outlines several steps that businesses should consider taking to prepare to comply with the law when it becomes effective on Jan. 1, 2027.
