Beginning October 13, CMS’ final rule prohibits the use of federal Medicaid funds for “sex-rejecting procedures” for beneficiaries under 18.

Since taking office in January 2025, the Trump Administration has pursued a series of executive, regulatory, and enforcement actions aimed at limiting access to gender-affirming medical care for minors. Those efforts reached a significant milestone on August 13, when CMS finalized a rule prohibiting federal Medicaid and CHIP funding for gender-affirming care provided to children and adolescents. The rule carries substantial implications for states, beneficiaries, providers, and health systems, while setting the stage for further litigation.
