IP Law Daily, TRADEMARK NEWS: USPTO releases revised Trademark Manual of Examining Procedure (TMEP), (Nov 4, 2014)
The USPTO late last week announced that it has issued the October 2014 version of the Trademark Manual of Examining Procedure (TMEP). The update includes precedential case law, new policies, and other changes that have occurred through October 1, 2014.
The October TMEP incorporates content from two interim examine guides: the Geographic Certification Marks Examination Guide 2-14 issued in July and the Service-Mark Specimens Exam Guide 3-14 issued in September. A complete index to changes in the October 2014 TMEP is available here.
The TMEP provides trademark examining attorneys in the USPTO, trademark applicants, and attorneys and representatives for trademark applicants with a reference work on the current law, practices, and procedures relative to prosecution of applications to register marks in the USPTO. The TMEP contains guidelines for examining attorneys and materials in the nature of information and interpretation, and outlines the procedures that examining attorneys are required or authorized to follow in the examination of trademark applications.
The USPTO also announced that the June 2014 version of the Trademark Trial and Appeal Board Manual of Procedure (TBMP) is now searchable.
