    By Saurabh Kashyap, B.A., LL.B.

The complaint requests a permanent injunction and monetary damages against the defendant for alleged trademark infringement, unfair competition, and trademark dilution.

American Airlines, Inc. has filed a trademark infringement lawsuit in Texas federal court accusing Advanced Air, LLC of infringing on its federally registered AA trademarks, which have been in use since the 1930s as indicators of the plaintiff's airline services. The complaint alleges that Advanced Air's use of the AA mark in promoting its own services is confusingly similar to American Airlines’ trademarks. Advanced Air has intentionally leveraged American Airlines’ established goodwill, misleading the public and causing irreparable harm to the plaintiff’s brand and reputation, the complaint further claims (American Airlines, Inc. v. Advanced Air, LLC, filed February 2, 2024).

The plaintiff, American Airlines, Inc. (American), is a Delaware Corporation with a storied legacy in the aviation sector and is recognized globally for its extensive network and history dating back nearly a century. The defendant, Advanced Air, LLC (Advanced Air), is registered in California and operates a range of scheduled commuter and private charter flights, primarily within the United States.

The complaint delineates several allegations against Advanced Air, including trademark infringement and unfair competition under the Lanham Act. American Airlines asserts that Advanced Air's adoption of the AA mark for airline services creates a likelihood of confusion among consumers, thereby diluting the distinctiveness of American Airline's marks. The plaintiff argues that Advanced Air's actions are not coincidental but a deliberate attempt to capitalize on the fame and trust American has built over decades, which is evidenced by Advanced Air's marketing materials and online presence that prominently feature the contested AA marks.

Furthermore, American highlights the specific ways in which Advanced Air is alleged to have infringed upon its trademarks, including the use of "AA" in digital and physical branding that directly competes with American's offerings. This purported infringement extends to Advanced Air’s interactive website and social media platforms, which, according to the complaint, target the same consumer base as the plaintiff. The suit points out the potential for customer confusion, which could lead consumers to mistakenly associate Advanced Air’s services with those of the plaintiff, thereby eroding the distinct value and recognition of the AA trademarks.

The lawsuit also outlines American's extensive use of the AA marks across various channels and products, underscoring the trademarks' incontestable status and the plaintiff's significant investments in marketing and brand development. Furthermore, the complaint asserts that these efforts have rendered the AA marks highly recognizable and valuable assets representing American’s services and loyalty programs. American has also emphasized the resultant goodwill and global recognition associated with these marks, which it alleges have been jeopardized by Advanced Air's actions.

In its complaint, American requests a permanent injunction to prevent Advanced Air from further use of the AA marks or any similar marks in a manner that infringes upon its trademarks or contributes to consumer confusion. Additionally, American seeks monetary damages, including statutory damages under the Lanham Act, all profits derived from Advanced Air's alleged infringement, compensatory damages for the dilution of its trademarks, enhanced damages for willful infringement, and an award of attorney fees.

    The Case is No. 4:24-cv-00134-O.
