In consolidated cases, two TEFRA partnerships were entitled to reduced charitable contribution deductions under Code Sec. 170 for conservation easements. The Tax Court found that the claimed valuations were substantially overstated and not supported by credible evidence. The partnerships acquired vacant land and later donated conservation easements to a qualified organization, reporting values far exceeding acquisition basis.

The Court found that the appraisals assumed intensive development potential, relied on unsupported highest and best use analyses and did not adequately account for regulatory and physical constraints. However, the Court determined that the conservation easements satisfied statutory requirements, including qualified conservation purpose and compliance with documentation rules, and that tax-motivated structuring did not negate the validity of the charitable contributions.

Also, the Court upheld the imposition of the gross valuation misstatement penalty under Code Sec. 6662(h), concluding that the partnerships did not have reasonable cause. The reliance on overstated valuations and unsupported appraisal assumptions justified the penalty.
