Antitrust Law Daily Wrap Up, SUPREME COURT DOCKET: Recent decisions, cases, and petitions pending High Court review, (Nov 12, 2014)
This Antitrust Law Daily feature presents a chart highlighting the decisions, arguments, briefs, and petitions on antitrust and trade regulation issues before the October 2014 Term of the U.S. Supreme Court.
To date, there are six antitrust and trade regulation cases docketed for the October 2014 term and the Court has agreed to hear three of them, relating to antitrust. Seven other cases, involving acquisitions and mergers, advertising, antitrust, consumer protection, and the Racketeer Influenced and Corrupt Organizations Act were denied certiorari.
On November 3, 2014, the U.S. Court of Appeals in Richmond, Virginia declined to review a decision in Kolon Industries Inc. v. E.I. Du Pont de Nemours & Co., rejecting claims that DuPont engaged in monopolization or attempted monopolization of the U.S. para-aramid market with its “Kevlar” fiber through long-term, exclusive supply agreements. The petition for certiorari asked whether, under 28 U.S.C. Sec. 455(b), a federal judge is relieved of his mandatory statutory duty of self-disqualification simply because neither party filed a timely motion to disqualify the judge.
