In case you missed the in-depth intellectual property law coverage in the March 2023 issues of IP Law Daily, here are highlights of the month’s most notable developments.

Among many important IP law developments last month, the U.S. Supreme Court held oral arguments in three cases—two trademark cases and one patent case. In Jack Daniel’s Properties, Inc. v. VIP Products LLC, the Court heard arguments about a dog toy parodying Jack Daniel’s whiskey trademarks. In Abitron Austria GmbH v. Hetronic International, Inc., the Court is considering the extraterritorial application of the Lanham Act. And in Amgen Inc. v. Sanofi, the Court is taking on the Patent Act’s enablement standards in a dispute over biopharmaceuticals. In other developments, the Copyright Office issued guidance to those seeking to register works created with the help of artificial intelligence. USPTO Director Kathi Vidal set forth additional guidance on the Fintiv rule regarding discretionary denials to grant administrative patent reviews, while a federal court of appeals decided to let Apple Inc. go forward with a challenge of the rule based on alleged failure to comply with Administrative Procedure Act requirements.

Those and other top developments in IP law from last month are discussed in a Strategic Perspectives article available here.
