A Michigan lawmaker has introduced legislation to bolster reproductive health privacy.

The Reproductive Health Data Privacy Act (HB 5769) seeks to regulate the collection, processing, and selling of reproductive health data. The measure would also regulate the disclosure of reproductive health data; require individual consent to collect, process, and sell reproductive health data; and prohibit the use of certain geofences around facilities that provide reproductive health services.

The bill provides for remedies and civil sanctions, including a private right of action for an individual who alleges a loss because of a violation of the law.

The legislation would empower the state’s attorney general to enforce the law and require the attorney general to promulgate rules of implementation.

Rep. Mai Xiong (D.) is the primary sponsor of the legislation (H.B. 7569, Reg Sess.).
