After two inspections, the contractor was cited for 10 safety violations for willful exposure of workers to fall hazards.
Recently, the Department of Labor’s Occupational Safety & Health Administration issued a flurry of citations to a Florida roofing contractor for allegedly exposing workers to fall hazards by not requiring them to wear fall protection under certain circumstances. OSHA has proposed over $750,000 in penalties.
Worker hospitalized after fall. According to OSHA, in March it initiated an investigation at an Elo Restoration LLC worksite in Jacksonville and, two weeks later, it initiated a separate investigation at a site in St. Johns after learning that a worker had been hospitalized following a fall through a residential roof while working on skylight fixtures.
The agency concluded that the worksite failed to install guardrails, safety nets, or personal fall arrest systems. Employees also were not provided with alternative fall protection measures. It also concluded that, at the St. Johns location, eye and face protective equipment were not used when machines or operations presented potential eye or face injury.
Citations. OSHA cited the roofing contractor with four willful, three repeat, a serious, and two other-than-serious citations. It alleges the employer willfully exposed workers to fall hazards by not requiring them to wear fall protection while working at least six feet above a lower level.
The employer has 15 business days from receipt of the citations and penalties to comply, request an informal conference with OSHA, or contest the findings before the OSHRC.
