    According to the charges, ConWaste suspended and discharged nine drivers and helpers and suspended another because of union activities.

    In late March, the NLRB Region 12 – Tampa Regional Director David Cohen approved a settlement agreement between Consolidated Waste, LLC (ConWaste) and Central General de Trabajadores (the Union). This settlement resolved four unfair labor practice charges against ConWaste related to its waste collection services in Gurabo, Fajardo, and Carolina, Puerto Rico. The charges included:

    1. Suspension and discharge of employees due to union activities, including efforts to organize;

    2. Maintenance and enforcement of work rules restricting union activities;

    3. Threats of discharge, loss of municipal contracts, and layoffs due to union activities and sympathies;

    4. Promises of improved wages and benefits to discourage union support;

    5. Interrogation of employees about union activities; and

    6. Creating the impression of surveillance of union activities.

    The settlement requires ConWaste to pay $215,877 in backpay, interest, and compensation to affected employees, revise work rules, distribute a revised Employee Handbook, post remedial notices, and mail these notices to current and former employees.

    “I’m very proud of the Subregion 24 team for their excellent work investigating these cases, calculating the monetary remedies, preparing for trial, and negotiating a comprehensive settlement agreement that upholds the guarantee in Section 7 of the National Labor Relations Act that workers have the right to organize a union and engage in other concerted activities for their mutual aid or protection,” said Regional Director Cohen.
