The Board’s quorum was restored following Wilcox’s reinstatement by a federal district judge.

The NLRB resumed activity by issuing four unpublished decisions Friday, March 7, following a federal district judge’s decision reinstating Member Gwynne Wilcox, who was removed without cause by President Trump on January 27. In light of the administration’s plans to appeal Wilcox’s reinstatement, and its broad assertion of the President’s alleged authority to fire executive officers with or without cause, it is uncertain how long the Board’s restored three-member quorum will last.

Judge Beryl Howell of the U.S. District Court for the District of Columbia Thursday held that the President does not have the authority to terminate members of the National Labor Relations Board at will, and that President Trump’s attempt to fire Member Wilcox was “a blatant violation of the law.”
