Garante, the Italian data protection authority, announced last week that it had “urgently and immediately” ordered a temporary restriction on the processing of Italian users’ personal data by an app designed to generate deepfake nude images.

In its announcement, Garante said the restriction was imposed on AI/Robotics Venture Strategy 3 Ltd., a company based in the British Virgin Islands that operates the ClothOff app. ClothOff offers a generative AI service that makes it possible, both for free and in some circumstances for a fee, to generate “deep nude” images consisting of fake photos and videos that portray real people in nude, sexually explicit, or pornographic poses. It allows anyone, including minors, to create such images, without any means of verifying the consent of the person portrayed and without warning of the artificial nature of the images.

Garante said it had launched an investigation to combat all nudity apps due to the high risk these services could pose to fundamental rights and freedoms, particularly with respect to the protection of human dignity, privacy rights, and personal data protection and especially in cases involving minors.
