Mary Lehner, former advisor to FTC Chairwoman Edith Ramirez and FTC Chairman Jon Leibowitz, has joined international law firm Freshfields Bruckhaus Deringer, as counsel in its antitrust practice, according to an August 5 announcement. She will reside in the firm’s Washington, D.C. office.
Lehner brings to Freshfields both government service and private practice expertise in the full range of antitrust, consumer protection, and foreign investment review issues. This expertise has been developed across numerous industries, including healthcare, energy, technology, airlines, construction, and publishing.
While serving two FTC chairs, she advised on antitrust investigations, enforcement actions, domestic and international policy initiatives, and congressional strategies. Lehner was closely involved in the Commission’s standard-essential patent enforcement policy initiatives and two notable Commission cases ultimately brought before the U.S. Supreme Court—FTC v. Putney Health Systems and FTC v. Activis, Inc. In the latter case, the Court held that reverse settlement agreements between brand and generic drug companies are subject to antitrust scrutiny. Prior to her role in the Chairman’s office, she was an attorney in the FTC Bureau of Competition.
A graduate of the College of William & Mary (B.A.) and the University of Chicago Law School (J.D.), Lehner is admitted to practice in the District of Columbia and the Commonwealth of Virginia. She is active in American Bar Association leadership, currently serving as Vice Chair of the Antitrust Section’s Merger & Acquisition Committee.
Freshfields Bruckhaus Deringer is a multinational law firm, headquartered in London, with more than 2,500 legal advisors and 28 offices in Asia, Europe, the Middle East, and North America.
