Antitrust Law Daily Wrap Up, INDUSTRY NEWS: Bingham Enhances Antitrust Practice with Hires from FTC, Justice Department Antitrust Division, (Apr 11, 2013)
Bingham McCutchen LLP has enhanced its antitrust and white collar-collar capabilities with the addition of FTC Senior Competition Adviser Darren Tucker and former Department of Justice Antitrust Division prosecutor Michael Whitlock, the firm announced today.
The former government officials have joined Bingham as litigation partners in the Washington, D.C. office. Both will work in the Antitrust, Competition and Trade Regulation Group, with Whitlock also joining Bingham’s White Collar Investigations and Enforcement Group.
At the FTC, Tucker served as senior competition adviser to FTC Commissioner Joshua Wright and former Commissioner J. Thomas Rosch. In that role, he reviewed and analyzed staff recommendations on all aspects of the FTC’s competition mission. Tucker was the principal drafter of the agency’s liability decision for In the Matter of North Carolina Board of Dental Examiners (2011-2 Trade Cases ¶77,705), an important case testing the power of doctors to exclude non-licensed providers that offer competitive services, as well as the closing statement for ESI/Medco (Trade Regulation Reporter ¶16,758), one of the largest mergers the agency reviewed in recent years. He also helped to develop the 2010 Horizontal Merger Guidelines (Trade Regulation Reporter ¶13,100) and the FTC’s antitrust enforcement statement governing accountable-care organizations that service Medicare patients under the Affordable Care Act.
An experienced prosecutor in international cartel matters, Whitlock served in the Department of Justice Antitrust Division, National Criminal Enforcement Section. While at the Department of Justice, he investigated several auto parts companies for price fixing, bid rigging, and market allocation in one of the largest criminal antitrust probes in U.S. history. He also prosecuted companies and individuals accused of collusion in the coastal-shipping and air-cargo industries. Whitlock served as a special assistant U.S. attorney in the Eastern District of Virginia.
Bingham’s antitrust group has more than 75 lawyers with significant and diverse experience in the U.S., U.K., and Asia. Bingham’s lawyers are involved in high-profile antitrust matters making headlines today, representing clients in industries such as technology (Intel, SanDisk, Sharp, QUALCOMM), financial services (Morgan Stanley, Royal Bank of Canada, Sumitomo Mitsui Bank), healthcare/pharma (Genzyme, Lupin), and energy (Shell).
Last year, Bingham added antitrust partners Ted Henneberry in Washington, D.C. and London and Stacey Anne Mahoney in New York.
Offering a broad range of market-leading practices focused on global companies, Bingham has approximately 1,000 lawyers in 14 offices in the U.S., Europe, and Asia.
