Cybersecurity Policy Report, Hamburg DPA Offers Guidance on ‘Right to Be Forgotten’, (Nov 12, 2024)
The data protection authority (DPA) for the German city of Hamburg has offered guidance on the “right to be forgotten” provided by the European Union’s General Data Protection Regulation (GDPR) and how recent court decisions could affect that right.
Under the GDPR, all EU residents have the right to have their personal data deleted unless the data is necessary “to exercise the right to freedom of expression and information,” but a claim for deletion exists if the individual’s fundamental rights outweigh other interests, the DPA said in a news release.
It noted, however, that rulings by German and EU courts required that case-by-case determinations were necessary to weight the rights of individuals against those of search engine operators and other online services. The easiest way for data subjects to assert their rights is to use the online forms provided by the search engine operators, the DPA said.
