Antitrust Law Daily Wrap Up, FRANCHISING & DISTRIBUTION NEWS: Hawaii Extends Temporary Reduction of Franchise Filing Fees, (Jan 22, 2013)
By John W. Arden, J.D., LLM.
The State of Hawaii has extended its 50 percent “temporary reduction” in securities and franchise filing fees for a one-year period, starting on January 1, 2013, according to Business Registration Information Release No. 13-01. Absent further action by the Business Registration Division of the Department of Commerce and Consumer Affairs, the fees will automatically readjust to their statutory levels on January 1, 2014.
Currently, the initial franchise filing fee, amendment fee, and renewal fee are all $125, reduced from the statutory $250 fees.
Since 2005, the Business Registration Division has intermittently reduced filing fees. From January 1 through December 31, 2012, the fees were reduced to the current level by Business Registration Information Release No. 12-01. The year before, the state did not extend the reduction, and fees reverted to the statutory level on January 1, 2011.
