Regulations promulgated under Executive Order 11246 prohibited certain Federal contractors and subcontractors from engaging in employment discrimination and set forth affirmative requirements.

Just before the July 4th holiday, the Labor Department published in the Federal Register its plans to implement Executive Order 14173, which revoked Executive Order 11246, under which regulations prohibited Federal contractors and subcontractors from engaging in employment discrimination. It also set forth certain affirmative obligations. The regulations also, with some exceptions, prohibited those employers from taking adverse employment actions against applicants or employees because they inquired about, discussed, or disclosed information about their pay or their co-workers’ pay.

The proposed rule would rescind those regulations, as identified.

Comments to the proposed rule must be received by September 2, 2025. Two public comments have already been submitted.
