Labor & Employment Law Daily Wrap Up, FEDERAL REGULATIONS—GSA rescinding federal management regulation allowing union solicitation in GSA-controlled buildings for contractors’ employees, (Apr 15, 2025)

It is also rescinding several FMRs referencing or relating to diversity, equity, and inclusion.
In tomorrow’s Federal Register, the General Services Administration (GSA) is announcing its plans to rescind Federal Management Regulation (FMR) Case 2022-02 (87 Fed. Reg. 54166, September 2, 2022), a final rule that had clarified that activities related to worker organizing and collective bargaining among contractors’ employees working in federal government facilities were not covered or restricted by the general prohibition on soliciting, posting, and distributing materials in or on GSA-controlled property.
According to the GSA’s notice, this rescission is in line with Executive Order 14192, entitled “Unleashing Prosperity Through Deregulation.” GSA states that it will amend the FMR to apply these changes. Now, activities related to worker organizing and collective bargaining among contractors’ employees working in federal government facilities will be covered or restricted by the general prohibition from which they were previously exempted.
DEIA-related rescissions and revisions. In a handful of other notices going into tomorrow’s Federal Register, GSA is also announcing its plans to issue rules to revise and/or rescind DEIA-related changes that were made during the Biden administration to certain FMRs, including ones relating to:
Designation of Authority and Sustainable Siting, FMR Case 2023-0012, originally published in the Federal Register on April 22, 2024;
Updating the Federal Management Regulation (FMR) with Diversity, Equity, Inclusion, and Accessibility Language, FMR Case 2024-01, originally published in the Federal Register on August 22, 2024;
Federal Advisory Committee Management, FMR Case 2022-01, originally published in the Federal Register on April 18, 2024;
Federal Management Regulation; Updating Transportation Management, With Diversity, Equity, Inclusion, and Accessibility Language, FMR Case 2024-03, originally published in the Federal Register on November 26, 2024; and
Art in Architecture, FMR Case 2021-02, originally published in the Federal Register on February 2, 2022.
According to the notices, each of these changes is being made “consistent with” one or more of Trump’s executive orders, including Executive Orders 14148, 14192, and 14219.
GSA also issued notices of rescissions related to a couple of Federal Travel Regulations, including the rescission of one that updated the FTR with DEIA language.
