    Faced with the growing problem of counterfeit and pirated goods entering the United States from abroad, it is essential for IP rights owners formulating a comprehensive brand protection strategy to understand and leverage the suite of enforcement tools provided by the nation’s primary gatekeeper, U.S. Customs and Border Protection (CBP). An article by Madeline Lei Momi Goossen, Jessica Bromall Sparkman, and Rod Berman of Jeffer Mangels Butler & Mitchell LLP details the practical steps attorneys can take to maximize the value of these enforcement tools.

    The authors describe using CBP’s programs and procedures that rights owners can use to protect their economic interests and their customers’ safety. These measures include detention, seizure, forfeiture, and destruction remedies, all of which hinge on rights owners making effective use of CBP’s system for recordation of trademarks and copyrights. “As global trade and the methods of counterfeiting continue to evolve, sustained collaboration with CBP should be seen as vital to any robust IP enforcement strategy,” they explain.
