The National Fair Housing Alliance, National Urban League, and The Arc of the United States backed the senators, saying HUD is not doing its job.
A group of Democratic senators sent a letter to U.S. Department of Housing and Urban Development (HUD) Secretary Scott Turner to express “deep concern” about what they said was the department’s lack of enforcement of the Fair Housing Act.
The senators said HUD has declined to investigate cases alleging housing discrimination, rolled back policies aimed at eliminating bias in the home appraisal process, and neglected to administer fair housing programs.
“Veterans, seniors, people with disabilities, survivors of domestic and sexual violence, families with children, people of color, and others are experiencing escalating fair housing challenges in their search for housing every day,” said the senators, led by Delaware’s Lisa Blunt Rochester. Complaints to private organizations and government agencies have reached record highs, they said.
“It is our assessment that HUD is purposefully eroding its ability to enforce the Fair Housing Act and inhibiting others’ ability to do so, thereby undermining the landmark legislation’s critical role in creating safe, decent, and affordable housing opportunities free of discrimination for millions of Americans,” said the senators.
“Despite previous Congressional outreach on these issues, HUD has failed to meaningfully engage,” the senators said. The letter concluded with a list of 10 questions for Turner asking for details about matters including the department’s handling of complaints, staffing levels, and funding decisions. They asked for answers in writing by June 4.
In addition to Rochester, who sits on the Senate Banking Committee, the letter was signed by Sens. Elizabeth Warren (D-Mass.), the ranking member on the committee; Catherine Cortez Masto (D-Nev.); Tim Kaine (D-Va.); Alex Padilla (D-Calif.); Jacky Rosen (D-Nev.), Adam Schiff (D-Calif.); Tina Smith (D-Minn.); Chris Van Hollen (D-Md.); and Raphael Warnock (D-Ga.).
The National Fair Housing Alliance, National Urban League, and the Arc of the United States all endorsed the letter.
“The Trump Administration is abdicating its responsibility to fully enforce the Fair Housing Act in the middle of the nation’s fair and affordable housing crisis, after promising the people of America improvements in housing opportunity,” said Nikitra Bailey, executive vice president of the National Fair Housing Alliance. “HUD is withholding fair housing funds Congress already appropriated, hollowing out the critical Office of Fair Housing and Equal Opportunity (FHEO), its own enforcement arm, and retreating from disparate impact—one of the most effective tools for combating illegal discrimination at scale.”
“The National Urban League strongly supports this call for accountability and oversight of HUD at a time when the federal government should be strengthening—not dismantling—fair housing enforcement,” said Marc H. Morial, president and CEO of the league. “This administration is not cutting bureaucracy or improving efficiency; it is recklessly cutting millions of people off from the promise of the American Dream.”
“Disability accounts for more complaints than all other protected statuses combined,” said Julie Ward, senior executive officer for public policy at The Arc of the United States. “By scaling back enforcement of the Fair Housing Act, HUD has abandoned its responsibility to ensure people with disabilities have their right to community living protected.”
