The back wages were paid for FLSA overtime and minimum wage violations, while the civil money penalties stem from child labor infractions.

The DOL’s Wage and Hour Division has separately announced its recovery of more than $113,119 in back wages for an unspecified number of employees working for a Georgia health care provider and a group of Texas restaurants for violations of the FLSA. The owner of the restaurant group also paid $25,706 in civil money penalties for child labor infractions. In addition, DOL announced a $5.6 million grant to help retrain individuals impacted by the closure of Spirit Airlines.

Straight time for all hours. Premier Health Consultants LLC, dba St. Joseph Candler Urgent Care, paid $113,199 in back wages to resolve reported FLSA overtime violations.

The urgent care facility in Richmond Hill, Georgia, failed to pay employees for hours worked and retaliated against a worker for questioning its pay practices, according to the WHD. Specifically, investigators found that the employer paid straight time instead of time and one-half in overtime for all hours worked over 40 when employees were required to attend mandatory orientation, meetings, and training. The employer also required certain employees to work off the clock, resulting in unpaid overtime, and suspended a worker who questioned pay practices, all violations of the FLSA.

Child labor, wage violations. The owner of three La Panaderia Bakery & Café locations in San Antonio, Texas, paid $25,706 in civil money penalties for violating FLSA child labor rules, in addition to an unspecific amount of back wages for minimum wage and overtime infractions.

Investigators determined that the employer hired a 13-year-old minor who was under the legal age for employment, and permitted a 15-year-old minor to work overnight, which is prohibited for 14- and 15-year-olds.

As for the wage violations, the WHD found that the employer failed to combine hours for employees who worked at multiple café locations, paying those employees straight-time rates instead of the required time-and-one-half overtime rates. The company further failed to pay one worker for two overnight shifts.

The entities subject to the investigation are Tequila Almond Croissant LLC, Pan Dulce LLC, and SA Bakery Co. LLC.

Worker retraining grant. DOL also said it awarded $5.6 million to the Florida Department of Commerce to provide retraining and skills development services for individuals and communities harmed by the closure of Spirit Airlines.

When the company ended operations in May, it displaced more than 5,000 workers in Florida and triggered related layoffs at aircraft cleaning, fueling, ramp services, concessions, food service, retail, ground transportation, airport logistics, and security service providers, according to DOL’s Employment and Training Administration. To date, an additional 223 workers have received Worker Adjustment and Retraining Notification Act notices, with the potential for additional layoffs.
