The order affects all currently pending investigative and enforcement activity.

Acting Secretary of Labor Vince Micone has directed the Department of Labor (DOL) to cease and desist all investigative and enforcement activity under the rescinded Executive Order (EO) 11246, as well as the regulations promulgated under it. The order, issued pursuant to the EO Ending Illegal Discrimination and Restoring Merit-Based Opportunity, which repeals EO 11246 and subsequent amendments, is effective immediately.

The order instructs the DOL to cease and desist all investigative and enforcement activity under the repealed EO, including pending cases, conciliation agreements, investigations, complaints, and other enforcement-related or investigative activity. The DOL must notify all regulated parties with affected open reviews or investigations by January 31, 2025, to inform them that the EO 11246 component of the review or investigation has been closed, with the Section 503 and Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA) components of the review or investigation held in abeyance pending future guidance.

The order applies to department employees in the Office of Federal Contract Compliance Programs, the Office of Administrative Law Judges, and the Administrative Review Board.
