As detailed in previous Products Liability Law Daily stories, the following Consumer Product Safety Commission actions are open for public comment until the dates indicated below. Comments may be submitted to the docket number identified in the heading of the document by any of the following methods: Federal eRulemaking Portal: Go to http://www.regulations.gov. February 4, 2025. CPSC has received notice of a revision to a voluntary ASTM standard that is incorporated by reference into CPSC’s mandatory standard for stationary activity centers. Staff is assessing whether the revised voluntary standard, ASTM F2012-24, Safety Standard for Stationary Activity Centers, improves the safety of the products (CPSC Notice of availability and request for comment, 90 Fed. Reg. 6844 (Jan. 21, 2025)).

February 11, 2025. Fitbit LLC has agreed to pay a $12.25 million civil penalty following charges from CPSC that it failed to immediately report a defect in its Ionic smartwatches that posed a substantial product hazard and an unreasonable risk of serious injury or death to consumers. The settlement agreement was provisionally accepted by the Commission and is subject to public comment (CPSC Notice, 90 Fed. Reg. 8201 (Jan. 27, 2025)).

February 28, 2025. CPSC has issued a direct final rule updating the mandatory safety standard for play yards to incorporate by reference the most recent version of the voluntary standard, ASTM F406-24, Standard Consumer Safety Specification for Non-Full-Size Baby Cribs/Play Yards. The rule will take effect on April 5, 2025, unless CPSC receives a significant adverse comment by February 28, 2025. If such a comment is received, the Commission will publish a notice in the Federal Register withdrawing the direct final rule before its effective date (CPSC Direct final rule, 90 Fed. Reg. 8368 (Jan. 29, 2025)).

March 3, 2025. CPSC has issued a direct final rule updating the mandatory safety standard for non-full-size cribs to incorporate by reference the most recent version of the voluntary standard, ASTM F406-24, Standard Consumer Safety Specification for Non-Full-Size Baby Cribs/Play Yards, except for the sections that apply exclusively to play yards. The rule will take effect on April 5, 2025, unless CPSC receives a significant adverse comment by March 3, 2025. If such a comment is received, the Commission will publish a notice in the Federal Register withdrawing the direct final rule before its effective date (CPSC Direct final rule, 90 Fed. Reg. 8676 (Jan. 31, 2025)).
